Canadian/International Probates

Sanger & Manes is a leader in the area of international probates, the court proceeding often required to transfer real property in California after the death of the owner who is not an American citizen.

Many Canadians and other foreign nationals own real property in California, particularly in the Palm Springs area.  When the owner dies and the property is not in a trust, the probate in their home country is not sufficient to transfer the property in California.  In those cases, a probate in California may be necessary to transfer the property to the intended beneficiaries.

These international probates require special knowledge of the documentation needed by the California probate courts, and of the complex rules on how estate taxes are applied to real property owned in the United States under applicable tax treaties.  Sanger & Manes is highly experienced in this specialized area of the law and can guide foreign fiduciaries through the probate and the estate tax process, including coordinating with the foreign probate, assembling the special documents required by California for international probates, meeting all the requirements to probate and transfer the property to the beneficiaries, and advising clients on the steps needed to comply Canadian or other foreign tax treaties to avoid or reduce any US estate taxes.

Finally, Sanger & Manes' staff has years of expertise in properly transfering the real property to the beneficiaries, and correcting title problems that may have occured in the past.
